1. General Provisions and Definitions

1.1 Parties to the Agreement

These Terms of Service and Conditions ("Agreement") regulate the rights and obligations regarding the use of the website and mobile applications ("Services") of Keşif360 (hereinafter referred to as "Platform", "We", "Company"). Any natural or legal person ("User", "You") who transacts, shares content or benefits from services on the Platform is deemed to have accepted all provisions of this agreement.

1.2 Definitions

Platform

Refers to the Keşif360 website, mobile applications and all related services.

User

Natural and legal persons registered on the Platform or benefiting from services without registration.

Content

All materials such as text, photos, videos, comments, reviews published on the Platform.

Premium Membership

A special membership package offering advanced features and advantages for a fee.

Business Account

Corporate user accounts that promote places and events for commercial purposes.

KVKK

Law No. 6698 on the Protection of Personal Data and all related legislation.

1.3 Acceptance and Scope of the Agreement

This agreement covers all services offered by the Platform and is deemed accepted in the following ways:

  • Completing the registration by becoming a member of the Platform
  • Sharing any content or commenting on the Platform
  • Purchasing a premium package or benefiting from paid services
  • Actively using any feature of the Platform
  • Opening a business account and conducting commercial activities

Important Notice:

If you do not accept any provision of this agreement, you should not use the Platform. You can contact us if you do not understand the terms of the agreement. These terms may be updated from time to time and we inform our users in advance about important changes via email or platform notifications.

1.4 Age Restriction

Users Under 18

You must be 18 years of age or older to benefit from the Platform services. Users under 18 must have the consent and supervision of their parent or legal guardian to use the platform. Accounts that do not comply with the age restriction are closed immediately and relevant legal proceedings may be initiated.

  • • Providing false age information is strictly prohibited
  • • Premium services are offered only to users aged 18 and over
  • • Legal capacity is required to open a business account

2. Scope and Definition of Services

Keşif360 is a digital platform that provides users with comprehensive information about cities, places, events and tourist attractions throughout Turkey. Our platform offers various services for both individual users and businesses.

2.1 Free Services

Discovery and Search

  • Search for places and events with advanced filtering
  • Category-based content browsing (restaurant, cafe, museum, park, etc.)
  • Location-based discovery with map integration
  • Find places near you
  • Popular and recommended places lists

Social Features

  • Comment and review (5-star system)
  • Create and manage favorite lists
  • Photo sharing and gallery creation
  • User profile and activity history
  • Social media integration

Information and Guide

  • Detailed place information (address, phone, working hours)
  • Event calendar and announcements
  • City guides and travel recommendations
  • Weather information integration
  • On-duty pharmacy information

Content Management

  • Suggest new places
  • Add and update events
  • Share tourist attraction suggestions
  • Information updates and correction suggestions
  • World tour category content sharing

2.3 Service Changes

The Platform reserves the right to improve, update or discontinue the services offered. Important changes will be notified to users in advance. Free services may be changed or discontinued at any time. In case of changes to premium services, current subscriptions are not affected during their term or an appropriate transition process is provided.

3. Membership Registration and Account Management

3.1 Account Creation

To become a member of the Platform, you must provide the following information completely and accurately:

  • Full Name: Real name information
  • Email Address: Valid and active email
  • Password: At least 8 characters, strong password
  • Phone: Required for verification (optional)

Prohibited Behaviors

  • • Using fake identity information
  • • Opening an account on behalf of someone else
  • • Creating multiple accounts (multi-account prohibition)
  • • Registering with bots or automated tools
  • • Using temporary/fake email addresses

3.2 Account Security

Security Measures

  • Use a strong and unique password (upper/lower case, numbers, symbols)
  • Update your password regularly (at least every 3 months)
  • Enable two-factor authentication (2FA)
  • Report suspicious activities immediately
  • Remember to log out (especially on shared devices)

Your Responsibilities

  • You are responsible for keeping your account information confidential
  • You are responsible for all activities on your account
  • You must notify us immediately of unauthorized access
  • You must keep your contact information up to date
  • You should not share your password with others

3.3 Email Verification

After creating your account, a verification link will be sent to the email address you provided during registration. You must verify your email address within 24 hours to benefit from all features of the Platform.

Note: If you did not receive the verification email, check your spam folder or request a resend. Email verification is required to benefit from premium services.

3.4 Account Types

Individual Account

For individual users who want to discover places, comment and share content

Business Account

For commercial organizations that want to promote places, events or services

Premium Account

For those who want to benefit from advanced features and priority services

4. User Obligations and Responsibilities

4.1 Account Security

  • Secure password: You are obliged to keep your account information secure. Use strong passwords with at least 8 characters, upper/lower case, numbers and symbols.
  • Confidentiality: You should not share your password with others. All responsibility arising from password sharing belongs to the user.
  • Responsibility: You are responsible for all activities on your account (payments, content sharing, comments, etc.).
  • Notification: You must report any suspicious activity, unauthorized access or security breach immediately to [email protected].
  • Current information: You must keep your contact information (email, phone, address) up to date. You are responsible for information updates.
  • Two-factor authentication: We strongly recommend enabling 2FA to increase your account security.

4.2 Content Sharing Responsibilities

When sharing content on the Platform, you must follow the rules below and be aware of your responsibilities:

  • ✗ Abuse for advertising purposes

4. Platform Rules

Illegal Activities

The Platform cannot be used for any illegal activity. We report suspicious situations to authorities.

Intellectual Property

The intellectual property rights of others must be respected and content must not be used without permission.

Commercial Use

The Platform cannot be abused for commercial purposes. Advertising is prohibited except for premium packages.

Malicious Software

Sharing viruses, malware or malicious code is strictly prohibited.

5. Payment, Billing and Premium Services

5.1 Premium Packages and Pricing

We offer various premium package options for businesses and individual users. All prices include VAT and are collected in Turkish Lira (TL).

5.2 Payment Methods and Security

Secure Payment System

All your payments are protected with 256-bit SSL encryption and processed through PCI-DSS compliant secure payment infrastructure (iyzico, PayTR). Your credit card information is never stored on our servers.

5.3 Billing and Taxation

  • E-Invoice System

    An e-invoice is automatically issued for all your payments and sent to your registered email address. E-invoice integration is available for our corporate customers.

  • VAT Application

    All our prices include 20% VAT (in accordance with the legislation of the Republic of Turkey). VAT is shown separately on invoices.

  • Invoice Date

    Invoices are issued on the payment date. In monthly subscriptions, a new invoice is created at the beginning of each period.

  • Automatic Renewal

    Premium packages are not automatically renewed. Reminder emails are sent 7 days and 3 days before your package expires. You need to renew manually.

6. Refund, Cancellation and Right of Withdrawal Policy

6.1 Right of Withdrawal (Distance Sales Agreement)

In accordance with the Consumer Protection Law No. 6502 and the Distance Contracts Regulation, individual consumers (natural persons) have the right to withdraw within 14 days of purchasing premium packages.

Conditions of the Right of Withdrawal:

  • The right of withdrawal can be exercised within 14 days from the date of purchase
  • You can send your withdrawal notice to [email protected] by email
  • Your payment will be refunded within 14 days after your withdrawal notice is received
  • The refund is made to the credit card or bank account you used for payment
  • Important: If you have started actively benefiting from the service (content published), you cannot request a refund.

Situations Outside the Scope of the Right of Withdrawal

  • • The right of withdrawal is not valid for corporate/commercial accounts (B2B sales)
  • • If the consumer has started benefiting from the service of their own free will and the service has been completed
  • • Services performed instantly and completed in an electronic environment
  • • Different conditions may apply to special campaigns and discounted purchases (clearly stated)

7. Privacy and Data Protection

The protection of your personal data is extremely important to us. As a Platform, we fully comply with the requirements of the Law No. 6698 on the Protection of Personal Data (KVKK) and the European Union General Data Protection Regulation (GDPR).

  • • Account information (username, password - encrypted)
  • • Transaction information (payment history, subscriptions)

  • • Location information (with your permission)

  • To fulfill legal obligations

7.2 Your Rights Under KVKK

In accordance with Article 11 of KVKK No. 6698, as a data subject you have the following rights:

  • • Requesting information about it if processed
  • • Learning the purpose of processing and whether it is used in accordance with its purpose
  • • Knowing third parties to whom it is transferred domestically/abroad
Correction and Deletion Rights
  • • Requesting correction of incompletely or incorrectly processed data
  • • Requesting deletion or destruction of data
  • • Requesting that correction/deletion operations be notified to third parties
  • • Objecting to unlawful data processing

For exercising KVKK rights: You can send your applications with documents identifying your identity to [email protected] or by mail to [Şirket Adresi]. Your applications will be answered within 30 days.

8. Limitation of Liability and Disclaimer

Important Legal Notice

Platform services are provided "as is" and "as available". We make no express or implied warranty that our services will be uninterrupted, error-free, secure or fit for a particular purpose.

8.1 Platform Responsibility

Situations Where We Do Not Accept Responsibility:

  • User content: Comments, photos, information and other content shared by users are the responsibility of the users. We do not guarantee the accuracy, reliability or appropriateness of this content.
  • Third-party links: We are not responsible for links to external websites on the Platform. The content and security of these sites are outside our control.
  • Business losses: We cannot be held responsible for any business loss, data loss, revenue loss or profit loss that may occur due to the use of the Platform.
  • Service interruptions: We are not responsible for service interruptions that may occur due to maintenance, updates, technical failures or force majeure.
  • Cyber attacks: We are not responsible for damages caused by DDoS attacks, hacking attempts or similar malicious attacks.

Situations Within Our Responsibility:

  • Ensuring the general functionality of the Platform infrastructure
  • Processing personal data in compliance with KVKK and GDPR
  • Ensuring payment security (together with payment infrastructure providers)
  • Removing illegal content within a reasonable time

8.2 User Responsibility

Users are fully responsible for the following when using the Platform:

  • Ensuring account security and protecting the password
  • Ensuring that shared content is accurate and legal
  • Respecting copyright and intellectual property rights
  • Acting in accordance with the laws of the Republic of Turkey
  • Being respectful to other users
  • Avoiding actions that threaten Platform security

8.3 Indemnification Obligation

Users, arising from the use of the Platform and;

  • • Violation of these terms of use,
  • • Unlawful behavior,
  • • Violation of the rights of third parties,
  • • Sharing misleading or incorrect information

as a result, they agree and undertake to indemnify the Platform, its employees and business partners for any damages, claims, lawsuits and legal expenses (including attorney fees) that may arise.

Force Majeure

We do not accept responsibility if we are unable to fulfill our obligations due to natural disasters, war, terrorist attacks, epidemics, power/internet outages, government decisions and similar events beyond our control (force majeure). In such cases, service delivery may be suspended or limited.

9. Account Suspension and Termination

9.1 Termination by the Platform

In the following cases, the Platform management has the right to temporarily suspend or permanently terminate user accounts with or without warning:

  • • Creating fake accounts
  • • Attacking Platform security
  • • Copyright infringement (repeated)
  • • Threats, insults or harassment
  • • Distributing malicious software

Termination After Warning

  • • Sharing spam content
  • • Rule violations (repeated)
  • • Sharing misleading information
  • • Publishing inappropriate content
  • • Using multiple accounts
  • • Harassing other users
  • • Failure to fulfill payment obligations

Important: Our account termination decisions are not final. You have the right to appeal. You can send your appeals to [email protected].

9.2 Account Closure by the User

Users can close their accounts at any time. To close an account:

  1. 1 Log in to your account and go to "Profile Settings"
  2. 2 Find the "Close My Account" option
  3. 3 Specify the reason for closing the account (optional but appreciated)
  4. 4 Click the verification link sent to your email address
  5. 5 Your account will be permanently deleted within 30 days

30-Day Waiting Period: If you change your mind within 30 days after the account closure request, you can reactivate your account. At the end of 30 days, the account and all your data will be permanently deleted.

9.3 What Happens When the Account Is Closed?

10. Dispute Resolution and Jurisdiction

10.1 Applicable Law

These Terms of Service and all relationships arising from the use of the Platform are subject to the laws of the Republic of Turkey. Turkish law applies to the resolution of any dispute arising from this agreement.

10.2 Authorized Courts and Execution Offices

In disputes arising from this agreement:

  • For Individual Consumers:

    The Consumer Arbitration Committees and Consumer Courts in the place where the user resides are authorized. In consumer disputes, alternative dispute resolution methods (mediation, consumer arbitration committee) should be preferred first.

  • For Commercial Users:

    The İstanbul (Central) Courts and Execution Offices are authorized. The parties agree to first try amicable consultation and negotiation for dispute resolution.

10.3 Alternative Dispute Resolution Methods

Before going to court:

1. Customer Service

Contact our customer service first. Most problems are resolved at this stage.

2. Consumer Arbitration Committee

You can apply to provincial/district consumer arbitration committees for consumer disputes.

3. Mediation

The mediation system is a fast and economical solution for commercial disputes.

Consumer Information System: You can apply online and get information about your rights at www.tuketici.gov.tr.

10.4 Monetary Limits (Consumer Disputes)

In consumer disputes, the application method is determined according to the monetary value of the dispute:

  • • District Consumer Arbitration Committee: Disputes below the determined annual monetary limit
  • • Provincial Consumer Arbitration Committee: Disputes above the determined annual monetary limit
  • • For current monetary limits: www.ticaret.gov.tr

11. Right to Amend the Terms

The Platform reserves the right to amend, update or reorganize these Terms of Service at any time, with or without prior notice. When important changes are made, we inform our users through the following methods:

Accepting Changes

Continuing to use the Platform after the updated terms are published means you accept the new terms. If you do not accept the new terms, you should stop using the Platform and close your account.
